С целью получения разрешения на закупку промышленной продукции из иностранного государства, необходимо осуществить следующий порядок действий:
1. Подача заявки:
- Заявитель (Заказчик) обращается в Министерство промышленности и торговли Российской Федерации (Минпромторг) через государственную информационную систему промышленности (ГИСП).
- Заявка заполняется в электронной форме в личном кабинете на сайте gisp.gov.ru и подписывается усиленной квалифицированной электронной подписью руководителя заявителя.
- В заявке указывается информация о заявителе, планируемом товаре, его характеристиках, сроке закупки, а также информация о проектах или программах, в рамках которых осуществляется закупка.
- Ответственное структурное подразделение Минпромторга проверяет заявку на соответствие требованиям в течение 5 рабочих дней.
- Если заявка не соответствует требованиям, она отклоняется и возвращается на доработку с указанием причин. Заявитель должен доработать заявку в течение 15 рабочих дней и повторно подать ее.
- Если заявка соответствует требованиям, ответственное подразделение сравнивает характеристики заявленного товара с характеристиками товаров из реестра российской промышленной продукции.
- Для транспортных средств применяются дополнительные критерии сравнения, такие как тип кузова, длина и ширина.
- Если выявлен аналогичный товар, Минпромторг запрашивает у производителя информацию о возможности производства аналогичного товара в требуемом объеме и сроках.
- Производитель должен предоставить информацию в течение 5 рабочих дней. При необходимости срок может быть продлен еще на 5 рабочих дней.
- На основании полученной информации Минпромторг выдает разрешение на закупку иностранного товара, если подтверждается невозможность производства аналогичного товара в России.
- Если подтверждается возможность производства аналогичного товара, заявителю направляется уведомление об отказе в выдаче разрешения.
- Разрешение действительно в течение 18 месяцев и распространяется только на одну закупку.
- В разрешении указываются наименование заявителя, наименование товара, его коды и реквизиты заявки.
- В случае несогласия с решением заявитель может подать заявку на пересмотр в течение 3 месяцев с указанием причин несогласия и документального обоснования.
- Минпромторг рассматривает заявку в соответствии с установленным порядком и может выдать разрешение, если заявка признается обоснованной.
